Interesting scenario. I've never heard of someone refusing FST but agreeing to blood test.

If you fail FST and refuse a breath test, that's enough for a conviction.

I did something very similar to this years ago.

I was at a friends drinking heavily. I ran to the store to get some smokes. On my way back a girl in an escalade slammed into my car coming out a driveway. I was almost to my friends house so I just went there. As soon as I got there I ran upstairs and grabbed a newcastle. The cop arrived about 20 minutes later. Of course the difference is that I had all my friends at the house to say I just started when I got back if need be, but it never came to that. He never said anything. I filled out the paperwork and it was over.

We have another shining example of someone who would contemplate ways to beat a DWI than simple not drink before you drive.

Your idea would be torn to pieces in court, by the way.

While we are on the subject. I took my conceal carry class with someone who asked the following

Officer "if you get a DUI while your weapon is on you, the consequences are much worse"

Classmate "but we are ok if our weapon is in the trunk, right?"

I have a friend who recently failed a FSB however blew below the limit, she was still charged with a DUI.
She literally had 2 glasses of wine over the course of 2 hours. On the way home someone pulled out in front of her, she swerved and hit a tree.
Cop came and gave her a FSB. She passed everything except the last part. When he had her walk a straight line, she tripped up on the second to last step.
Cop immediately put her in hand cuffs and had her blow. She blew just under the legal limit, don't recall what the numbers were. Ironically, she has a badly torn miniscus in her knee, which does cause her problems with walking. She had already had her surgery scheduled to have this repaired at the time this happened. Her lawyer is using this to fight the DUI.
It's complete BS, she should have never been charged with a DUI. The cop even told her husband that she wasn't intoxicated at all, but he still had to bring her in and charge her. This was on a Friday evening, they kept her until Sunday afternoon for this shite.

In TN if you are sleeping it off in the backseat of your car and your keys are in the vehicle you can still be charged.
