Yep I don't usually drive after 1 tall boy, but that's just because I feared a DUI in the military. I've gotten yelled at for others getting DUIs. So OP, it could be worse.
Bet you won't do it again. You obv see how little it takes. And I agree .08 is BS FWIW. It is the holidays and ppl are out. Cops are out too.

You'll make it through. If this is your first one, go through deferment, pay your fine and do your pee tests and it'll be over before you know it and expunged off your record.

depends on state law where you are about refusals, but if you're around the limit you think, make your choice. If your BAC drops a tiny bit from when you get hooked to the time you get back to blow, it can make the difference. All depends how long it takes for him to leave the scene and drive you back, initial process, explaining rights, etc. If OP is honest , he should have blown but done everything to slow it down as possible.

Exactly. Texting and driving is probably more dangerous but they don't seem to have a big problem with that and certainly don't enforce those laws because it's too difficult to prove.

There's a reason they do the breath test last they're hoping you just concluded drinking and began to drive. Your BAC will still be rising.
Where it becomes tricky is what your BAC was AT THE TIME of driving. That's what the state has to prove.
If you get popped and it takes an hour to get to jail, another hour or two to get a warrant for your breath/blood at the station...your BAC may have gone up or may have gone down.

Most DUIs are just away to generate income for local and state officials. If your impaired that's one thing. But there are people in the news with several dui and accidents and nothing is really done simple because they have no money

Exactly. I bet almost everyone on here that drinks has driven after 3 drinks. Hell, me and some of my coworkers occasionally go have 2-3 pints after work which is probably enough for a DUI even though I'm not the slightest bit buzzed. I rarely drink and get behind the wheel but there's a big difference between someone that's lights out smashed vs having 3 beers.

Look at it this way: getting caught last night may have prevented you from killing yourself and/or someone else in the future. Learn from it.
If this is your first DUI many jurisdictions have a "mulligan" provision in their DUI statute that allows a judge to offer you a way to get the charge removed from your record.
You have to meet certain requirements, such as no additional violations over a certain time period, completing a safe driving course and maybe spending some time doing community service work.
You might want to check out if that's an option for you.
