I honestly dont see how one can logically say you get to pick your sex, but you cant pick your age....

This scenario is certainly more appalling but it's absolutely the same thing as transgenders or Sean King/Rachel Dolezal.

I am not aware of any of these legalities or any legislature being passed that has given transgender people rights to be treated as the other gender in the event that they commit a crime.

I don't think you can pick. But I do think some people are born with some sort of chemical imbalance, or their environment has shaped them to identify as the other gender.

Until we address that as a chemical imbalance rather than allowing these people to say they are how they feel, then a defense like in the OP should be valid. To me, there's no difference between a 40 year old identifying as 8 and a man identifying as a woman.
