How are prisoners buried? Isn’t it in Angola where the prisoners prepare burial plots for those who die in prison?

That's where the incontrovertible evidence that they are guilty comes in. Two or more eyewitnesses, DNA, video... absolute proof that they did it absolutely.
For example, there is not a question in anyone's mind that Dylan Roof is guilty. There's not a single question in anyone's mind that Patrick Crusius did it. Sorry, but they get what they gave.

In murder cases where it is 100% certain and proven that the accused did that shite, then yes, let the victim's family hit that motherfricker in the head with bricks until it's done.

None of the above is absolute proof...
Two eyewitnesses? That didnt work out so well in the Inquisitions...
DNA? Google "Boston Crime Lab" and see how many years the crime lab tech got for falsifying crime records at prosecutors requests, then the corresponding thousands of convictions overturned...
Video? Its not all its cracked up to be.

Sure. Those are the easy ones to solve, but every prosecutor with any amount of ambition will take a capital case to court to open up political ambitions if he thinks he can win- not to determone guilt. Thats the real problem here.

I’d like to be for the death penalty in cases where a murderer is caught in the act and it is obvious he/she committed the crime. Buuuut...

This is the reason I’d have no problem getting rid of it. In a perfect world guys like Tsarnaev and Dylan Roof and James Holmes would just be taken out back and shot. Ok, maybe they get a trial but still, executed swiftly once the inevitable is ruled. Anyone else where there is some aspect of the case that is refutable, no death penalty because people are stupid and juries get it wrong all the time.

Seems as though death penalty cases are more political than judicial. I don’t trust the govt to get it right the first time. Govt should never be in the business of killing its own citizens.

This is the only issue but it’s the major issue. Too many convictions based on nothing more than unreliable eyewitness testimony.
So I’m for the death penalty in the easy cases where there is insurmountable evidence. But our system doesn’t work that way. There aren’t different levels of guilt (although in Louisiana there sort of was until recently when death required unanimous jury instead of 10 votes).

Eyewitness testimony is horribly unreliable but most people don’t realize it. And some courts won’t even allow an expert to explain to a jury exactly why it’s unreliable.

I believe in the death penalty because it contributes to a more orderly society. If it is invoked for the most heinous and onerous crimes and has withstood the test of the appeals process then it is as equitable an outcome as is humanly possible. Without the ultimate penalty for capital crimes there will be no sense of justice for those who are aggrieved by the perpetrators of horrendous crimes. We never want citizens or their loved ones who are victimized by violence to feel that they must take the law into their own hands to receive justice. There is a thin line between justice and revenge and it is up to the justice system to ensure that the line is never crossed. Just my 2 cents.
