Trump has never given a rat’s arse about any law he doesn’t like.

Seems this would justify the president to impose tariffs.
Why didn't Trump use it, then, is the question
Gotcha. Seems a simple solution would be for Trump to invoke it.

I wish these courts found Obamacare illegal.
Funny how that worked.
Trump had the perfect opportunity to repeal and replace the ACA, but he tripped over his own dick and couldn't get it done.

Section 338 is likely unconstitutional, but switching to 338 as legal authority would result in all new legal challenges.

No, that traitor McCain fricked that up.

Because of Trump. Trump needed McCain, but couldn't admit it to himself. If Trump hadn't treated McCain like shite, the ACA would've been repealed.
We'd still be fricked, because it turns out the Republicans lied and didn't actually have a replacement plan.

Isn't Section 338 a law passed by Congress?

Yes, and it is probably an unconstitutional law. It has never been used to impose tariffs, so whether it is Constitutional has never been challenged.

We'll see.... Trump has folks advising him that understand Constitutional Law better than folks on a discussion board.

but once his reasoning under IPPEA is struck down he could then invoke this act to do them again (if what you say is true) Which would he pretty funny. Then it would have to go through the courts again.
And, the Treasury might have to refund all tariff monies collected under tariffs that were improperly instituted.
What a Shiite show.

I doubt it.
That's too much money. Congress would retroactively legalize those tax rates.

There wouldn't be much of a point to it either.

Things aren't bad enough.
Let's hope Trump continues to move us further and further away from that and SCOTUS doesn't frick it up.

Just look at this as another opportunity for an embarrassing opinion from a certain "Justice."
