Section 338 is likely unconstitutional, but switching to 338 as legal authority would result in all new legal challenges.

Because of Trump. Trump needed McCain, but couldn't admit it to himself. If Trump hadn't treated McCain like shite, the ACA would've been repealed.

We'd still be fricked, because it turns out the Republicans lied and didn't actually have a replacement plan.

Yes, and it is probably an unconstitutional law. It has never been used to impose tariffs, so whether it is Constitutional has never been challenged.

I doubt it.

That's too much money. Congress would retroactively legalize those tax rates.
