Gov says the decision to proceed to sentencing is based on the totality of Flynn's assistance. Has already provided “vast majority” of his potential cooperation. Highlights indictment unsealed yesterday against Flynn’s business partner.
Judge Sullivan: So Flynn could’ve also been charged in that indictment unsealed in Virginia yesterday, right? Gov: Yes.
Judge Sullivan: “Exposure to Mr. Flynn would have been significant?” Gov: Yes.
Judge Sullivan:
“This crime is very serious. In the White House! In the West Wing! It’s a very serious offense. You can’t minimize that"
Judge Sullivan to Michael Flynn: “Arguably, you sold your country out."
Judge Sullivan: “I’m not hiding my disgust, my distain for this criminal offense. I can’t guarantee you are going to avoid incarceration. Why don't you speak to your attorneys again."
Judge Sullivan is now asking government if Flynn could have been charged under the Logan Act, or if there are any other charges that Flynn could have faced.
Judge Sullivan even asked the government whether Flynn could have been charged with treason for interfering in Russian sanctions imposed by Obama administration. Government didn’t want to go there.
They’re now taking a recess until 12:30, at Flynn’s request.

Could you imagine all the Logan Act charges the government would have the opportunity to pursue if Mueller went down this avenue? After Flynn they can start with John Kerry.

Dude. I don’t know if boozie is a PD or not....but there is nothing wrong with it. As a former prosecutor, I can say there are some fine lawyers and litigators that are PDs. Like prosecution, you can’t make any money doing it long-term....so most good litigators move on after a few years. But ragging on someone for getting a law degree, passing the bar, and representing indigent defendants is pretty silly.

I’m not a PD, but I just let him run with it because it’s his thing.
I agree that there are really good PDs out there, especially in the federal system.
That’s just his go-to ad hom for me.

I know plenty of dumbarses that passed the bar and got a law degree from Thomas Jefferson. He gets coffee for a salary. But congrats to him
