Context matters.
If it was just a random pedestrian and a driver. Then the pedestrian would try to avoid and the driver would try to stop the car.
If the driver has broken federal laws and is about to be arrested... and a law enforcement is standing to the side of the car and in front of the car to prevent the driver from escaping... then any hostile action that can lead to harm that the driver does.. is seen as an attack on law enforcement, and they can and will use force.
If a driver is just minding his own business and a violent mob surrounds his car and starts attacking his car and trying to pull him out.... then the driver is justified in slowly driving through the mob to get away.
The way you are framing your question by placing responsibility on the pedestrian.. is implying that the driver was in the right and it's up to the pedestrian to get out of the way. Akin to the third situation I wrote. About a driver being surrounded by a violent mob.
