If Republicans really wanted to do this, they would, and they would so it in such a way that let JBE issue a new state of emergency and looser guidelines.

He's bluffing if he says he wouldn't issue a new one.

Of course they don't really want to do it.

Open does not mean they don't have a disaster declaration.

That's the problem for the Republicans. They can undo the disaster declaration easily (majority vote EITHER chamber) but changing the restrictions requires legislation (majority both chambers AND subject to veto).
