A President cannot do that about those particular documents unless Congress gives authority to do so. National Defense is shared with Congress, Constitutionally.

I will not pretend to know every twist and turn of PRA and if it specifically allows for National Defense and Security records of that level to be simply taken home.

And you also are forced to take the DOJs word that they WERE there and I am not going to take their word.

So is there a SOP or not on documents for an exiting president? If there is then the DOJ can provide a signed off list inventorying the documents. Otherwise trying to build a case around a missing "murder weapon" isnt the best approach to hang your cockiness on.

He’s a loon, but he is partially correct. The President cannot wave his hand, declassify nuclear related documents, and then show them to people who wouldn’t have original clearance for them.

I don’t think Trump did any of that though. IF he did it would be an issue for him for sure, but I don’t think he did.

Constitutional power over National Defense is shared with congress under Article 1 Section 8, and that includes declassification which needs to be codified for those docs. The Atomic Energy Act, among many other acts, passed by congress and signed by a President conceding control over classification, controls the process.

The President does have broad power in this regard but not absolute.

Do you really think a President could declassify let’s say our most secret advanced nuclear weapon documents, say “these are declassified”, and then show them to anyone he wants, including say Xi? Of course not.


Again, I don’t believe the DOJ.

I don’t believe this to be true when it comes to National Defense documents.

Can you point me to the specific case law you’re referring to?

There is no record of it. The one thing that happens at that level of government is voluminous record keeping because 70% of your life becomes CYA.

Whom did Trump communicate these declassifications to at the time he declassified? He was sloppy and unorganized and as a result stupid things come back to bite him on the arse.
