You can never really tell from supreme court arguments but I can definitely see the upholding of Roe but the striking down of Casey. That would give some like Roberts some cover.

She has not made one logical argument why Roe makes sense aside from the Supreme Court decided Roe.

she'd dead wrong on everything, and her logic makes no sense. but she's got a good delivery and knows how to debate. one can be confident and dead wrong at the same time. she knows how to play the non answer/answer game, which has been known to fool a lot of the people a lot of the time.

Brain dead people don't have physical reactions. Their bodies have autonomous reactions the same way your knee moves when it is tapped. It's not the the same way an unborn child reacts to being poked and prodded.

Kav - you identify critical interests - the other side says there is interest in fetal life. (FINALLY). The reason this issue is hard, is that you have to allow one interest to prevail over the other. What is your reaction? How do you allow woman to prevail over baby, and so she why should this court be the arbiter? (Ppl in diff states value differently).

Mississippi- death people have ignored “safe haven laws” that relieve burdens placed by being a parent or you’re not ready. The lowest cost Abortion $600. The costs of contraception is lower.
Overruling Roe would keep the court neutral.
This is unique for woman and baby. Should be left to the ppl to decide.
It took 58 yrs for this court to recognize seperate but equal is wrong. We’re Running up on 50 yrs of Roe.

In a way I think yes. But I think they will overrule the part of Casey that says stare decisis shouldn’t apply to Roe.
The justices did to some extent signal that the other privacy cases (birth control, gay marriage, etc) would remain unaltered if Roe were overruled.
Roberta will find a way to punt.
Kagan and Breyer will vote together.
Wise Latina will write some nonsensical dissent.
Kav, Alito, Thomas, and Gorsuch will vote together.
Law in this area will still be a shite show.
The thing that they’re struggling with is how to make a constitutional standard regarding the point in pregnancy that it’s ok to have an abortion. I don’t know how they make a decision that has legal precedent without having evidence. There’s no legislative rule saying “viability” so a rule saying 15 wks is no different. It was pulled out of the air as a policy judgment by Mississippi.
Roe never made sense and Mississippi is right. The problem is that there is no objective standard in law for court to fall back on, and it has politicized the SCOTUS and done much damage to our court system. abortion is a legislative determination, not judicial and i frankly hope that Roe is overruled for violating the separation of powers doctrine.

Maybe I'm being naive, but the Constitution's silence on the issue itself should be a slam dunk for allowing states themselves to determine the legality/availability of abortion services by virtue of the 10A.
It's really not that complicated.
For their argument that it's "part of the fabric of our society," so was slavery. And segregation. And voting rights for white men only.
