Not sure if I’m disremembering, likely am, but wasn’t there some statue that one can’t classify simply to cover up and hide government malfeasance?

No one is disputing that a President has the power to declassify.
What is the dispute?
I don't believe that has ever been laid out clearly and concisely. There is a ton of confusion by the internal court proceedings and external interpretations of the dispute.
The way I see it ALL of the information is declassified.
The dispute is over who should have custody over certain documents Trump took to MAL. Specifically the documents in folders marked "classified" which does not mean they are currently classified.
The nature of the dispute is the disposition of those documents going forward. The DOJ wants to take custody of those documents and lock them in a safe forever. Trump would like to keep those documents for his own use and at the same time protect any sources and methods contained in the documents.

Trump was the incumbent when he declassified the material in question.
When he declassified -some- material. There is no evidence (and no assertion from Trump's legal team) that the stolen documents recovered by the FBI in the Mar-a-Lago search are those documents.
If he had proof that the only documents he'd stolen were documents he had declassified and could legally possess, why won't he assert it?

But there is a process that will have evidence of that document status.

You can't magically delicious think things from classified to unclassified.

There is no evidence to the contrary either. And Trump did not steal the documents. They were packed by National Archives.

Trump is the process
just this week the Special Master trump chose, plus 3 federal judges on the 11th circuit, 2 of whom trump appointed, said these docs are still classified. trumps lawyers do not dispute that. judge cannon, who trump also appointed, does not dispute that.
why do you think that is? do you think they never heard of this wish based declassification? you think your post about trump being the entire process isnt taught in law school? is the entire American legal system, including the people working for or appointed by trump, simply lying? you think theyre all wrong and your Facebook meme is rigth?

Your authority is based on what? Who sent you?

There is evidence to the contrary. They bear classification markings, thus by the legal definition they are classified. Trump's team has been given multiple opportunities to show that they were declassified, and they have never been able to do so.

And Trump did not steal the documents
If that were true, he would have returned them when asked instead of hiding them.

You must be new here if you haven't realized that the far right wing represented here runs largely on wish-casting.

They don’t care. They just needed a compromised judge to sign a bullshite warrant. It was an evidence retrieval mission and smear effort. They knew it would not result in a criminal prosecution.

They did not say this. They removed the stay on the documents "marked classified" by Judge Cannon.
You are also confusing "classified" with the process of keeping "sources and methods" still secret which the SM is trying to honor.
quote:
why do you think that is?
Because Trump's lawyers wanted them to make the assertion then they can challenge said assertion.

Well if that's the case it should be pretty easy to prove
The raid wasn't about what is or isn't classified; it's about the fake Russian collusion and the proof Trump has.

That is the dispute.
The DOJ thinks they own them and Trump thinks he owns them.
It was initially okay with the National Archives so they packed the docs up for Trump and he took them down to MAL. On June 3rd Trump honored the DOJ request to review the docs and they came down from DC to MAL and took a look. The DOJ tried to get the docs back through the National Archives but apparently it wasn't going well and they were getting antsy. So approximately 3 months after their invited visit to MAL they raided his MAL residence and took the documents.

Even in the DOJ's filing to the 11th they never said classified documents. They specified "marked classified".
Why not simply call them classified documents if they are classified? Why go out of your way in a legal filing to the 11th and say "marked classified"?
The answer is simple. The DOJ simply wants the documents "marked classified" back in their possession. They did not assert the documents were classified.

They have classification markings. Per US law, the DOJ is correct.

If the easiest way to determine classified documents is by their markings, why not just use that? Makes it easier for the judges to give the DoJ their well-deserved win against Trump's idiot lawyers.

This is exactly right.
And all the other stuff they seized was to funnel to Adam Schiff, Liz Cheney, the media et al for opposition research purposes.
