State law is you have to file returns, you don't have to have them paid.
So someone can get a refund, not haven't filed, would be ineligible.
While someone who has filed, but owes, is eligible.
Also Destroya has federal issues, not state.

I like how the appeals court ruling suggested that to run for office you have to have sent your taxes in by certified mail for the last 5 years.

Well, I have had a couple of times the last few years, where we e-filed a client's return to LDR, we got an acknowledgement from our software that LDR received and accepted the return, and yet, months later, LDR will say, we don't have it. And when we send them the confirmation, they still say, well, that's great, but we don't have it.

Cliff notes: Team Broome sued her probable top two competitors in Watson and Wicker. Watson is in the clear for now. Court initially ruled Wicker was cleared. Appeals court ruled Wicker is ineligible to run. Wicker is now appealing and has a 2:30 press conference today.

Tara Wicker (probably the favorite) for Mayor had a lawsuit brought against her to disqualify her from running due to not filing state taxes for 2 years 2016 and 2018. She won the initial lawsuit, but it was appealed and now that candidate is disqualified.
Due to:
A) The incompetence of LA Dept of Revenue
B) The fact that the person who filled the records request at LDR is married to someone who works for the current mayor's campaign
C) Another lawsuit challenging another candidate for mayor (Matt Watson) has been filed as well
Louisiana politics/corruption is afoot.

To add: The lawsuit against Wicker involves her not filing state tax returns. Candidates must attest in their paperwork that they have filed (or extended) last five years of LA returns. Wicker did.
SWB's people filed a public records request and the state said they could only find 3 out of 5.
At trial, Wicker says she did file all 5. Judge believes her.
SWB's people appeal. Appeal court reverses district court.

East Baton Rouge Parish has a joint city/parish government where the mayor and the parish president are the same person and elected parish wide. Rather than have a Baton Rouge city council and a parish council, there is instead one metro-council for the entire parish. The sitting first term mayor president, Sharon Weston-Broome, is up for re-election this fall. She is vulnerable because despite running as a business friendly moderate, she has governed in a manner openly antagonistic to many local businesses. At the same time, she's not particularly well-liked in the black community because she isn't from Baton Rouge and is seen by many as an outsider and an Uncle Tom who hasn't done enough for them.
With this in mind, she has two black female candidates opposing her for mayor/president. A moderate metro council woman in Tara Wicker, and a radical marxist in Denise Marcelle (Denise has spent the past 4 years working for Broome on multiple appointed boards and commissions). The main republican challenger in the race is metro-councilman Matt Watson. To help take out her competition, Broome had surrogates file lawsuits against each of her main competitors (Broome and Watson) to attempt to disqualify them from the race.
Watson was challenged by someone within a rival's campaign, Piazza, who is a relatively young bar manager whom everyone seems to believe is an idiot toolbag. Watson won his challenge at the District level, though I'm sure an appeal to the 1st Circuit by Piazza's camp is still pending.
Wicker was sued by someone inside the Broome camp whose spouse works at DNR, claiming that Wicker is ineligible due to unfiled tax returns. Wicker won the case at the District level, but that District Court decision was just overturned at the 1st Circuit Court of Appeal. This case will definitely be decided by the State Supreme Court. The shimmy is that in order for the Broome camp to even know about the unfiled taxes, someone at DNR would have had to commit an ethics violation to tip them off. The fact that the person at DNR in charge of checking this stuff is married to a Broome staffer is an obvious conflict of interest. This whole thing looks like a setup from the jump.
If Broome wants to win, she has to keep both of those candidates off of the ballot and/or out of a runoff. Broome likely wins in a runoff against Marcelle (because Marcelle will be seen as too radical for the business class) or Piazza (because he's an idiot who has no ideas, name recognition, or money to campaign with).

Could you imagine the fallout if Broome's attempt to knock-off Wicker actually resulted in Mayor Cantrell getting ousted?

I thought Piazza's camp had dropped the lawsuit? The only lawsuit remaining on Watson is from Broome's camp right?

As fun as that would be, it wouldn’t take effect until the next election. Too late at this point to toss her in favor of the runner up.

Everyone is forgetting about Carter. He’s the dark horse here- moderate R with some crossover appeal for city dwellers and rural voters. He’s old but a decent politician that never was a hard-liner. He could win in the right circumstance.
