I doubt it will pass, but I’d give it a 60% chance of being upheld by courts if it did.

States have more discretion on regulating obscenity. Obscenity is not protected by the 1st Amendment, and in most places, pornography would be considered obscene.

Ya'll understand what this would mean right? No more porn online, no more exposure of fetishes, that door into the human mind will be closed shut. Localized AI have no laws or rules regulating it. Scary to think what would that imply but i can see an ambitious politician pushing for this then defunding the budgets regulating and enforcing online porn laws. Then using all that money to fill their slush funds or pet projects. Then overtime talking of sex will be an even more taboo subject due to lack of exposure anyonen in the political realm would have to appear more pure in thought. It's a bit of a dynamic I would say.

If I remember correctly the last time SCOTUS addressed porn was to yield in deference to "artistic" merit. In other words as long as the production has some kind of story to it sex is allowed. Kinda explains all the gratuitous sex in everything, comedies, drama, horror, you name it.

So, if the states define "artistic" more conservatively I can see state laws surviving challenges.
