You have to demonstrate that you are reasonably attempting to make sure employees are in compliance.

A friend is the head of HR for a large company and they are putting all kinds of policies in place to conform with that while it still giving them some pretty giant wiggle room.

If the OSH Act grants OSHA authority to prevent/enact policies relating to general hazards like COVID, etc..... that is the only argument the administration will need.

If they are acting in their assigned lane and complying with admin law/their enabling legislation, they pretty much can do what they want.

there would be a compliance system put in place. it won't be hard to enforce. rosters of non vax vs vax, the dates tested, and dates vaccinated with documentation.

OSHA has the authority to check the company's records though under this ETS. Employees can also self-report their company if they believe they are not following the mandate.

So Karen knows her company is nonchalant about the vax records, reports them to OSHA, OSHA comes in to check records and they get to make a public example out of the company. Media coverage, massive fines... other companies fall in line to avoid the same.

This is a completely different case under a different mechanism from the feds, concerning only one subsection of employees

The first argument was regarding OSHA's authority to issue workplace mandates relating to COVID.

This second one is a separate issue and concerns the stay put in place on the CMS mandate for healthcare workers to get the vaccine.

Previous discussion was about the OSHA mandate for 100+ employee companies.

This discussion is about healthcare workers, specifically healthcare facilities treating Medicare/Medicaid patients.
