then you have the middle-roaders: ACB/Kavanaugh (thanks a lot, Trump)
It wasn’t Trumps fault, idiot. He had to pick candidates the senate swamp would approve. He could have chosen bleeding liberals as the only alternative.

Looks like they just tell the gov, yeah we're in compliance thanks.
You have to demonstrate that you are reasonably attempting to make sure employees are in compliance.
A friend is the head of HR for a large company and they are putting all kinds of policies in place to conform with that while it still giving them some pretty giant wiggle room.

it is Hearing this Biden case
quote:
Biden v. Missouri
Issue: Whether the Supreme Court should issue a stay of the injunction issued by the United States District Court for the Eastern District of Missouri blocking a federal rule that requires all health care workers at facilities that participate in Medicare and Medicaid programs to be fully vaccinated against COVID-19 unless they are eligible for a medical or religious exemption.

I mean from a company standpoint. Looks like they just tell the gov, yeah we're in compliance thanks. You could upload a lucky charms box top as your vax card and it will probably pass.

their case seems thin other than "OSHA" gets to interpret what they feel is dangerous and do what they want
If the OSH Act grants OSHA authority to prevent/enact policies relating to general hazards like COVID, etc..... that is the only argument the administration will need.
If they are acting in their assigned lane and complying with admin law/their enabling legislation, they pretty much can do what they want.

How does this even get enforced? It looks like it would just be on the honor system
there would be a compliance system put in place. it won't be hard to enforce. rosters of non vax vs vax, the dates tested, and dates vaccinated with documentation.

What decisions specifically caused this board to declare that Kavanaugh and Barrett are bad picks?

OSHA has the authority to check the company's records though under this ETS. Employees can also self-report their company if they believe they are not following the mandate.
So Karen knows her company is nonchalant about the vax records, reports them to OSHA, OSHA comes in to check records and they get to make a public example out of the company. Media coverage, massive fines... other companies fall in line to avoid the same.

What did they just argue if they are now arguing the same thing? I am so confused.

No, I'm asking a question. Care to give an example?

No fricking shite
We already know how 6 will rule:
Kagan, Soto, Breyer: Mandate 100%
Thomas, Alito, Gorsuch: No Mandate 100%
Roberts, ACB and Kav are wild cards.

This is a completely different case under a different mechanism from the feds, concerning only one subsection of employees

The first argument was regarding OSHA's authority to issue workplace mandates relating to COVID.
This second one is a separate issue and concerns the stay put in place on the CMS mandate for healthcare workers to get the vaccine.

they are arguing health care workers working for a place that accepts medicare medicaid should be mandated the vax.
spending clause?
spending clause?

So all arguments and debate over the emergency temporary standard from OSHA are complete?

Previous discussion was about the OSHA mandate for 100+ employee companies.
This discussion is about healthcare workers, specifically healthcare facilities treating Medicare/Medicaid patients.

I'm sure that ServiceNow, WorkDay, People Soft, and Kronos are already on top of that. Companies will just have to pay for the option.
