How in the world can you defend that?

Might as well keep it safe and out of the hands of the enemy that is our government. It's safer with trump. Seriously he is the ONLY man in the world I'd trust that with having that info. There isn't a virtuous person in our federal government at this moment. they all should be locked up.

In October 2020, Trump tweeted, “I have fully authorized the total Declassification of any & all documents pertaining to the single greatest political CRIME in American History, the Russia Hoax. Likewise, the Hillary Clinton Email Scandal. No redactions!”


The Heritage Foundation's Stimson has a view, given that Trump was once "the ultimate declassification authority."

“If any president decides to declassify a document and doesn’t tell anybody — but he has made the decision to declassify something — then the document is declassified,” Stimson said.

He added that “there’s a rich debate about whether or not a document is declassified if a president has decided but not communicated it outside of his own head,” but Stimson said he would rather be the defense than the prosecution if the dispute ever went to trial.

Maybe I am missing something. My interpretation is that they have a very high level description of the documents. They do not have the documents.

This is probably a pretty grey area. Kash Patel even indicated that the "classification markings" weren't formally changed by White House counsel, but that Trump really did mean for them to be declassifed.

Then there's this quote from Mark Meadows, after Trump went on Twitter and said everything about Hillary and the email server was declassed

You understand that "home" is a building under constant secret survive surveillance and protection, right? So any random jackass gets too close, they get arrested and potentially shot if they appear to be a threat. The only way anybody would get access is in a raid like the FBI conducted.

Those documents were more secure there than most any other place in the country. Certainly, they were more secure than sitting on a random server that could be accessed by foreign agencies.

And is there any evidence he declassified said documents? Where's the paper trail?

A President doesn't simply say "I hereby declare these documents declassified" and voila, there it is. There are laws, procedures and regulations that govern this.

Garland is taking that position; however, the ability to declassify documents is pretty broad and given by the constituation. Legislation generally can't restrain that power. See Department of the Navy v. Egan, 484 U.S. 518 (1988)

I don't know if Trump invoked the dick waiving method of declassification, but it seems the current dispute is on when he waived his dick and how many documents he waived his dick over rather than if he did so by some specific process.
