North Carolina appeals court on Tuesday rebuffed the Republican National Committee’s (RNC) request to not process certain overseas ballots in the upcoming election unless the voter shows they were previously a resident of the key battleground state.

A three-judge panel of the North Carolina Court of Appeals on Tuesday unanimously rejected the RNC’s appeal after a trial judge refused the party’s request for an intervention ahead of the upcoming presidential election…

…North Carolina’s rules enable citizens who have never lived in the United States to vote in the state, as long as they haven’t registered elsewhere and their parent or legal guardian was previously an eligible North Carolina voter.

How can they rule allowing the breaking of a federal law?
Federal law is only citizens can vote in a federal election.
Surely the RNC appeals.

Easy solution. Count those votes towards DC's total. (DC is not a state and absolutely should not have the extra two electoral votes that come with a state's Senate representation.)

This is absolute bullshite.

The voting laws need to be changed so that you have to be a sole citizen - no duel citizen bull crap. Return to the country for minimum of 6 continuous months every 5 years.

That should be enough requirements, but maybe more should be added.

I wonder what documentation is required to prove the elements of registration. Is it an affidavit? If the person lies under oath, does North Carolina have jurisdiction to prosecute them?

My dad is a Louisiana resident and Air Force veteran. We moved our entire life to different countries and cities every two years. When I turned 17 I got my license in Louisiana and registered to vote there that summer. I never lived there, but that was home.

This is what this ruling accommodates and is not worthy of outrage.

Considering this only applies to active servicemembers stationed abroad, that is an interesting jurisdictional question given all the federal protections given to them.

But....I imagine the state would be able to prosecute the servicemember once they're back in the US not on active duty status.

It's not going to change through legislation. We are getting very close to the point of no return. At some point things are going to have to get ugly for things to change unfortunately.

I doubt the RNC would protest if it was just service members. The statement reads as if the law was intended for service members but doesn’t strictly apply to service members.

I hate the federal gov but something will have to be done about this cheating in elections.

There is no argument for how this should be allowed.
