Asylum Grant Rates Plummet Under Trump

There are a few big reasons:

1) The grant rate under Biden was inflated because many cases were dismissed. Means typically only people with very strong cases got to a decision.

2) Biden issued the Circumvention of Lawful Pathways rule in May 2023 which made a large, large majority of people prima facie ineligible for asylum. If you look at the chart that's about when you see the drop in approval rate. A lot of those cases are now coming ripe.

3) DHS had used Asylum Cooperative Agreements to move for termination of many case before getting to the merits. Those have mostly come to a stop in the last month or two however.

4) The Temporary Immigration Judges were brought in specifically to deny, especially in the detained setting. A lot have been denying under Matter of H-A-A-V- which is essentially summary judgment. A lot of these decisions are flawed, but convincing a detained person to appeal and spend another year in detention is difficult.

Biden’s people thought they were so smart setting all those asylum hearing dates out to 2026 and 2027.

My limited involvement with asylum was a time when this guy was a plaintiff being deposed and said he came here 20 years ago and applied for asylum.

He got a drivers license and SS number and never had a hearing.

That does happen. I've had cases where it took over 7 years to get interviews, but also have some that takes less than 6 months. The asylum office was doing LiFo for a long time so had some funky delays.

From a Florida standpoint, I think everyone was coming in, applying for asylum with some Miami law firm and just never had hearings. Got all the docs and just worked.

When the court ordered him to disclose his asylum stuff and appear again he left the country.

So the rates dropped because biden was letting in anybody he could.

That seems to be mich clearer.

What annoys me is some of the nonsense with immigration.

A somalian claims asylum or refugee status due to fear of persecution at home......then takes a vacation to somalia to visit relatives....they should not be let back in the country.

They protest ICE??? Immediate deportation.

And of course the ole fail safe marry your brother.

Biden's CBP paroled most people into the US until around 2024 when his polling became atrocious. That is the "open border" policy.

At the same time, his DHS promulgated a rule that said if you didn't enter with CBPOne without a limited exception you were ineligible for asylum. That made most of those people ineligible for asylum.

So on one hand he helped them, on the other he screwed them.

The policy has been for at very long time that after 180 days of a pending asylum you get work authorization and a temporary SSN.

There's a huge underground market of "paralegals" and "notarios" who will tell people they will get them work permits and then file frivolous asylum applications for them.

Trump has started to tighten up on getting those work permits, and lowered the validity from 60 months to 18 months.

Been an immigration attorney for almost 10 years.

Not some crazy open borders liberal, but also not a mass deportation guy either. We have a very flawed system that very rarely gets accurately reported on neutrally.

I dont understand Biden's decision. He defended Obama's immigration policy as a candidate , but increases parole of migrants and ignores that and the border until 2024 when it was too late.
