It’s probably a way for the NCAA to save face. Allow the kid to play without the NCAA admitting it was at fault with messing up the testing protocol. It saves them for future litigation.

There is no way that LSU people were confident. No shot. They had probably decided that it was best to show confidence. But, nobody who has worked with or even paid attention to the NCAA would have been confident.

they all drank the kool aid that fulton's lawyer was serving. the only media i heard pour cold water on this was hanny and ott. the rest of the media drank the kool aid and convinced the fanbase he had a chance.

Exactly. It was pretty obvious that all of the optimism was coming only from Fulton's lawyer. I'm still waiting for the first person to tell me what exactly the "new evidence" was. I kept hearing all this about new evidence, but then they would only talk about the NCAA using the wrong rule to punish him. Well, that's not new evidence, fellas.

It would have been very easy for the NCAA to come out and play the good guy and say, "by the letter of the law, the suspension was handed down correctly. However, in this case, the right thing to do is consider the surrounding details. The player in question in fact passed the drug test. We felt that despite the fact that a 2 year penaly was the correct ruling, a 2 year penalty given the circumstances would have been to severe of a penalty."
They didn't. That would have been a PR positive for the NCAA and would have saved them from any future litigation.
The truth is, they aren't scared of litigation. The NCAA has the right to set and enforce rules within the NCAA. As long as the rule enforcement doesn't exceed the scope of the NCAA, and doesn't cross lines from a protected class standpoint, they really can't be touched.
This waiver won't be granted. I'm not sure LSU is even willing to file it.
That's another thing. I think people have indicated that LSU is the party that needs to file the waiver. Does that mean LSU would be a party to the lawsuit?

Only chance is if this issue can get some legs nationally. Hopefully the big dogs of college football will look close at this case and make some waves.
