Do you understand that if the Title IX coordinator was not informed of the allegation, that in and of itself can be a Title IX violation?

I will wager money on it as long as you don’t stipulate if there was a report filed or not. He’s getting fired either way but you seem to trust him, so no bail out if he didn’t in fact report it to OSU

So if this was one of his athletes instead of a coach, do you think the athlete would be under a TItle IX investigation? Because there's no difference here in Faculty/Staff/Students. They all fall under it.

OSU is currently under three separate investigations by the US Department of Education due to Title IX violations.
Part of Title IX compliance is making sure any complaints are handled by the Title IX coordinator. In this case, it's likely the coordinator would have determine Smith was unlikely to create a hostile environment on campus, but it's imperative he/she is allowed to make that call. If that person isn't afforded the opportunity to do his/her job, the school can be in violation of Title IX.
