Having been through a divorce battle, these two characteristics should move a attorney to the top of the list.

Practically, you may have to get the court involved to force her to let you see your daughter.

If the child is of the marriage, you have to wait one year from the day she moved out to finalize your divorce (unless you can prove she cheated and qualify for a fault-based divorce).

I'm sure you will end up waiting the one year period to get a no-fault divorce. If you married later in life, don't worry about any alimony. As far as property settlement, you mentioned she gave up interest in the house. If it was done properly, perhaps that is still your separate property. However, everything else you acquired since you married will be split, unless you have a pretty solid prenup that is in accordance with Louisiana law.

Good luck, and try not to get impatient. Not sure if you've been here before, but it is a methodical and strategic process.

Yes it will be a no fault divorce. Not worried about alimony.

Not sure what you mean by done properly for the house, at closing, she signed a 1-2 page document stating she gives up all interest in the property.

Not really worried about other assets. We had separate retirement accounts from before we were married. Nothing at all got comingled.

That will be my problem being patient. Especially when it comes to time with my daughter

I said this in another divorce thread...

Go out and hire the best lawyer in the state TODAY. I cannot stress enough the importance of finding high powered representation. If you think it's expensive to hire a big time lawyer, just think about how bad you will get hosed with a shitty lawyer. You'll pay through the nose in support, etc, etc.

Trust me. I've been there. I crushed my x in court with what was considered at the time to be the best lawyer in my state. It was a frick ton on money but I sleep better because of it.

I have never heard a single divorcee that went up against her & had it work out.

She gets husbands who cheat all of their money, child custody, & the property.

Seriously, show up at her office 1st thing Friday. Don't leave until she's your legal counsel.

Kobetz will settle 90% of the time.
