The cop pulls up info on his laptop and sees the prior arrest. He charges you with a second. The DA gets the charge and sees there is no prior conviction just a prior arrest and charges you w a first.
Or the DA’s office charges you w a second and your lawyer will get it reduced. Or your public defender will miss it too and you will be screwed.

I’ve had a couple friends in this situation and I’ve never seen an incorrect 2nd offense reverted to the 1st offense that it should be.

Why would I pay you a dime? You’re so careless that you neglected to read the 3-4 statements I made, IN BOLD NONETHELESS, that state that I have never been arrested nor convicted of any DUI or DUI related offense.

Maybe not the details but it would definitely be allowed as far your character goes and it would be mentioned that you were previously a person on trial for it.
However, ragrding the DWI, if you took a plea or an 894 or whatever there were stipulations in that about not being arrested for DWI again or t would make all of that null and void.
If your charges were dropped then it still will show on your ARREST record that you were arrested for this previously. So when the cop runs your information it will show that you were arrested previously and if you’re within the 10 years, then you get the 2nd offense charge. It will later get sorted out by the DAs office when they do the digging into the court records and see that t was dropped or you were not guilty. The cop arresting you doesn’t typically have all the outcomes from the court cases in your electronic record.
