I cannot imagine the pain of losing a child. I feel for the man, but he’s going to sue everybody. He might as well sue her.also. She’s not nearly 100% free of accountability for ending up in that situation. I hate to say it but it is reality.

But it seems like I’m these instances lawyers name everyone especially ones with the deepest pockets, and Lyft would certainly qualify.

I don't know if this has ever been fixed, but I do know that at one point, personal auto insurance stopped covering drivers the moment they accepted an Uber/Lyft passenger, but Uber/Lyft insurance didn't actually begin covering drivers until the passenger entered their car.
If the driver was on his way to pick up another passenger, this lawsuit might ruin his life monetarily on top of the mental anguish I'm sure he's already dealing with.

Louisiana in a nutshell. Something to do with why no insurance companies want to come here anymore, and why our auto insurance rates are completely out of whack with rest of the country.

I said this in the large thread. The driver was tested and cleared after waiting for police to arrive. He was going slow, roughly 15 MPh when he hit her. Unfortunately the way he hit her was what killed her, directly from behind. It caused her neck to snap back. If she was standing in any other position she would most likely be okay. Really sad situation.

This has been said already but what if it comes out that the Lyft driver was able to see her in the sreet but was looking at his phone and hit her. Lyft driver is apportioned 40% fault at trial. Plaintiff's recovery is educed by 40% and there's no one to collect against.
Attorney did not sue Lyft because of all the dopey reasons in this thread. Attorney gets sued for malpractice.
There's legal considerations for doing what was done. Just because you all believe that lawyers are scum per se does not mean this lawyer was wrong.

The Romans used to make the plaintiff cover all court costs, including for the defendant, if they filed a lawsuit and lost. That would be a good start.
Disbarring lawyers who go with the old buckshot approach would do nicely, as well. shite like going after Lyft in this suit is a big reason why insurance costs have skyrocketed.

And if all this bears out under oath, Lyft may be able to get out on summary judgment. Then the other defendants won’t be able to point at the empty chair in trial, the plaintiff’s lawyer hasn’t committed malpractice, and the victim’s family gets some clarity and closure about their daughter’s last moments.

I know the area was poorly, if at all, lit, but how do you hit someone when you are only going 15mph with your head lights on?
