Certified pre-owned Lexus RX350 SUV, Dealer sticker $35K for 2015 with around 20K miles, should be able to buy for around $32K

You can get a barely-used Infiniti Q50 for mid $20s. Here's a $ 2017 Q50 3.0t for $26,000.
You should easily be able to find a new one for mid-30's if you play the cards right.

Criteria is a luxury or entry level luxury brand for under 40K and mid sized....
BMW 3 series (non-cheapo version) is too small and probably too expensive
Cadillac ATS is way, way too small.
Cadillac CTS is too expensive.
Jaguar XE is too small. And British.
Mercedes CLS is too small and too crappy
Mercedes C300 is very nice, but too small
Lincoln MKZ is too crappy.
Chrysler 300 is a little old school.
Buick LaCrosse probably over $40k well equipped.
Lexus ES is over $40K well equipped...and it's butt ugly.
Audi A4 is an excellent vehicle but might be on the small side of mid sized.
Acura TLX may have the fewest drawbacks for the size and price constraints.

Mercedes E350, 2-3 year old lease returns wholesale for $28,000 ~ $30,000, basically 50% of their cost new.
I can put you in touch with a flat fee specialty dealer who has access to MB Financing's direct auction/wholesale distribution division. It's basically eBay on steroids for higher end cars. There are equivalent direct wholesale channels for BMW and Infiniti too, Lexus primarily distributes lease returns by auction.
You save thousands over a traditional dealer, the car is inspected & graded, the car will still be under factory warranty. I bought a 2015 Lexus ES with ~20,000 miles from him four months ago, I'll never buy a car from a traditional dealer again.

If mainstream brands are okay, the Impala and Avalon are both excellent vehicles that are very nice when fully loaded.

Really like the look of the new Kia Stinger
That being said I have no idea how it drives and yes I am aware its a Kia so take it for what its worth. Advertising under $40 though.

Can get the Lexus ES350 new for pretty much that price (think we paid 38 for a mid level package). Certainly not luxury, but it's entry level luxury. Not an exciting car, but it's very comfortable. Fit's four adults comfortable (I'm in sales and needed something like that with decent mileage). Can't complain.

In-laws had one. It's a one off experience and they probably just treated it like crap. Car was about 4 years old and I had to drive it somewhere right when I was shopping for vehicles. This rode like crap. Felt like it was falling apart. Again, I realize they probably just treated it like shite, but that was my only experience in one. Liked the Lexus better anyway, so went with that.
Another bonus for the Lexus is regular fuel. The Acura and Infiniti required premium if I recall correctly. Audi/BMW/Mercedes were too small for me at that price range.
