Right, I could be legally responsible for someone else's damages (if I back into your car), but that doesn't mean that any attorneys were involved. Or need to be involved.

You have trouble reading?

I'm not going to bring it to court. If my insurance can't straighten it out or a letter drafted to the dog owner can't get his homeowners insurance to pay for it I'll take care of it myself.

Though some of you now have me wanting to take this all the way.

I had someone with me. The guy was in his yard. He told me and my buddy it was his dog. He gave me his business card in case I needed someone to back up my story to the insurance company.

Dog owner was doing yard work in the front yard and you get his info.

From the OP, it sounds like the owner didn't have any problems admitting ownership initially, maybe he's a better person than most and will accept responsibility for having his dog running willy nilly in the streets.

You're saying you'd refuse ownership of the dog and would accept responsibility? Or let your insurance company handle it?

Correct. Because in many states it is absolutely the dog owners fault. If I could find the LA code on it I could simply present that to the dog owner and hopefully he'd just let his home owners insurance cover it.

I just want one person here to say that it's not his/her fault if they were the dog owner. How can you dispute this?

It's definitely the owners fault.

The Louisiana Civil Code articles you're looking for start at 2315. You don't want to hire a lawyer for this. Also, a lot of these people are assuming that guy has homeowner's insurance. I had a friend who hit a HORSE that had been tied up to a house in a rural area. Lots of damage to the car, medical bills, etc.. the horse owner was renting.

Anyway, sucky situation, but I think you're in the right to feel like it's the other guy's fault. You might still be better off just claiming it on your insurance and chalking it up to a life lesson.
