Dig up the cracked part of driveway. Remove whatever is in the way causing cracks. Repour driveway. Have a beer on new driveway while jamming to whatever Kiss song you like most and laugh as your neighbor has to slowly watch his tree die.

Are we discussing a cypress tree or oak tree?

How long has the neighbor been there? 75 years? Did he plant the oak tree? Not that it would matter legally, it would just make you seem like a dick... Think about how ridiculous that sounds, to sue someone because a tree that they didn't plant is causing damage to a driveway you knowingly built on top of said tree's roots.

Uh, no. They are only liable if the tree is rotted out at the base, weakening the tree's stability, or, if it's dead, or, if he trimmed it in such a way as to shift all weight towards someone else's property and it fails. At least it's that way in Texas. Damn lawyers in Louisiana probably can find a way to sue someone if their leaves blow into your yard, though.
