Dig up the cracked part of driveway. Remove whatever is in the way causing cracks. Repour driveway. Have a beer on new driveway while jamming to whatever Kiss song you like most and laugh as your neighbor has to slowly watch his tree die.

As noted earlier in this thread, the same neighbor planted 2 cypress trees only in recent years close to the other part of my driveway, and is starting to raise havoc to my yard, flower bed and driveway. I do have the right to ask him to do something about it, unless he wants to pay for my damaged driveway down the road.
Are we discussing a cypress tree or oak tree?

How long has the neighbor been there? 75 years? Did he plant the oak tree? Not that it would matter legally, it would just make you seem like a dick... Think about how ridiculous that sounds, to sue someone because a tree that they didn't plant is causing damage to a driveway you knowingly built on top of said tree's roots.

They are liable for cleanup of it falls but that’s it.
