Cell phones have largely eliminated the need to go "seek help" at some stranger's house in the middle of the night.
When I was in h.s., some guy ran off the country road near my parents' house and was hurt - dogs sounded off as he came up to the house. Woke me up and went outside - the guy was very cautious and quickly made it clear why he was there.
I wouldn't want to do that in this day and age.

Isn't it legal to shoot looters in riot situations?
I wonder this as well.....I had my shed broken into a couple of years at at 6 am on a Sunday morning....I wasnt home but my security cameras caught the whole thing on tape.....I wonder if I would have been home and happened to walk in the backyard to drink my coffee and confronted this guy, would I have been within my rights to walk back inside get a gun and shoot him while he was rummaging through my shed?

my understanding is yes, but if he tries to flee while you confront him, you can't go shooting him in the back running away.

i think the problem you would have is going inside and getting a gun. The problem would be well why didn't you call 911. Now if you go out with a gun and still feel threatened I think its more likely you won't get charged...but I have no idea

LOL... do what?

according to the comments on NOLA.com the man was bashing cars in the mans driveway...I dont think that gives him the right to shoot them man....maybe he should have stayed inside and called 911
Just because you're too much of a pussy to go out and confront someone a-hole that is damaging your personal property, doesn't mean that the shooter in this case doesn't have the right to. In fact, he is perfectly within his legal rights to frick them up. And, I applaud him for doing so (if the comments on NOLA.com, as you mentioned, are correct).

the dead man was Seth Riley Flores, 22. His fiancée, Kirsta Maelyn Flores,
That's odd.

Pretty sure you can't just shoot someone in your yard. They have to be trying to actively break into your home or car. You can't just shoot someone for acting what you perceive to be erratically in your yard. Dude should have gone inside, locked the door and called the cops. Another life wasted for no good reason, imho.

In Texas it is perfectly legal to shoot someone that is in your yard or on your property if it dark outside.

Yeah, let's not blame the guy actually committing the fricking crime.

Calm down Luke...why are you so angry?

In Louisiana you actually can. We had a case like this in NOLA a few years ago. The homeowner wasn't charged. A little excerpt as to why Cannizaro didn't charge him:

"State law," the source noted, says "there shall be a presumption that a person lawfully inside a dwelling, place or business or motor vehicle held a reasonable belief that the use of force or violence was necessary to prevent unlawful entry thereto or to compel an unlawful intruder to leave the premises."

What crime? A dude in your yard in and of itself doesn't constitute a crime.
That's what the police are for.

If the homeowner came outside and told the person to get off his property and then he came towards the homeowner in a threatening manner, then yes the homeowner can shoot him legally.

Seems like he wasted his own life with his actions....

But she said Flores had caused problems in the neighborhood, and the Sheriff's Office had been called on previous occasions because he was suspected in car break-ins.
quote:
Flores had a criminal record, including a conviction for a misdemeanor count of simple battery in 2016 to which he pled guilty, a third-offense possession of marijuana charge to which he pled guilty in 2014 and three felony counts of simple burglary in 2013 to which he also pled guilty.
