Sand berm

Anyone know the latest on this? Seemed like that's all Nungesser talked about for two weeks. I thought I heard last week that they had approval and money to do a small part of it. Haven't heard anything else and an internet search turned up nothing.

I think Wed is "D" day for the decision. He gave BP until then to order it built or he will commence on his own.
I saw him in an interview where he said Weds or bust for BP to "step up" and protect our marshes. He is realistic in the fact that he knows it is not the answer to stopping all the oil, but to sit around and do nothing is unacceptable.
Lawyers out there, is the stae of Louisiana able to file suit against BP for all these damages for negligence of not acting quickly/loss of tax revenue/etc.? Couldn't it include individuals who support certain industries in the state so they don't have to necessarily go after BP as individuals.

It would be difficult, but one could argue that BP's failure to take known measures to prevent damage could rise to the level of "gross negligence" that could bring it out from under the $75 million cap on general damages.

BP agreed to pay for 2% of it so far.

army corp is saying if the berms are built it could push the oil to mississippi,alabama and florida instead of plaquemines parish. billy pretty much busted a spring after the corp said that, so basically they are still fighting.
