You are correct more than likely. Let us hope that we can shove through election reforms and then it is very much possible. Until then probably not.

Democrats did not bring this before the courts. It was two family owned toy manufacturers who have their products made in China. The two companies are Hand2Mind and learning Resources. They had to raise their retail prices by about 70% to make up for the new tariffs that they were being charged.

How many tariffs are instituted via IEEPA?

Look the way the system works is you gotta to get enough people to get angry and vote out almost all of Congress. Then you tell them to prohibit lobbyist in DC
Its been a cesspool for a very long time and many of the issues we currently have are because of a historically weak Congress (i.e. Last 30 years or so)

I'm not an expert, but it sounds like what's being argued isn't the constitutionality of tariffs themselves, but whether the President has the authority to institute them unilaterally.

Congress did give the President authority to charge tariffs including the following situation:
Section 301 (Trade Act of 1974): Grants authority to retaliate against "unfair" foreign trade practices, investigated by the USTR.
It seems like this could be applied to most situations. However, I don't think the President has the authority to make blanket worldwide changes to the tariffs. So you can't change it worldwide but you can on an individual basis. That's how I read it anyway. If I'm right then Trump must get the USTR to agree that a country is trading unfairly.
