Whren v United States was the worst decision ever affimed by the Supreme Court.
Easy to avoid it. Don’t commit traffic infractions. Even small ones. Then you’ll be good.
It’s also called denying consent for a search and don’t have anything illegal in the vehicle if they request for a K9. Have a valid DL, insurance and don’t have a warrant. Cops probably won’t mess with you.

It's not easy to avoid. There are traffic laws you don't even know exist.
I only recently found out its illegal to have those tree air fresheners hanging from your mirrors. I watched a guy in Arizona get pulled over for that after an officer followed him for over 15 miles. The guy ended up out of the car getting his vehicle searched and an hour of his life wasted.
pulled over for airfreshner.
You don't even have to commit a violation to be pulled over. All the officer needs is probable cause that an infraction occurred. Which can be made up from the time it takes him to walk to your window.
Officers will search if they want to. K9 are less accurate than a coin flip and they can be made to indicate. Officers can bypass all of that if say smell Marijuana. There is nothing to challenge it.
Officers have testified before congress that is nearly impossible for the average American to drive to work and home without committing multiple infractions.

Did they ever start defunding the police? That's inviting criminals to your city like telling South America that the US-Mexico border is opening. Is it really hard to grasp what happens next?

Police budgets are horribly managed like all other government budgets.
Do you know how many cops steal 10s of thousands of dollars in OT.
Cops caught have testified that it is part of the culture of policing.
There are cops that claim to work 70 hours per week all 52 weeks of the year and nobody audits that shite.
There are cops making more than Governors. Budgets are out of control and need to reigned in.

I was pulled over once because ONE of two lights on my truck's rear bumper was out. The lights that shine on the license plate. Not a taillight or brake light. The tiny white lights, lol. One was working just fine. Pulled over anyway. Some cars don't even have bumper lights that shine on the plate, lol. I'd been working late and I suspect the officer thought I had no business being out at 1:00am.
That said, if you have a warrant out for illegally possessing a firearm, and you're being told you're under arrest, and you try to resist arrest and get back into your car, I can see how that might make a police officer jumpy.
Was the officer right to shoot him? Who knows at this point.

Rolling through a STOP sign is a misdemeanor. If the LEO expected the perp to roll through a STOP sign, then that's a conspiracy. A conspiracy to commit a misdemeanor is a felony. Just saying.

I wasn't arguing for or against this guy who was killed. I couldn't care less.
I'm arguing against pretextual stops being constitutional. It's impossible to follow the traffic code without committing an infraction.
It encourages over policing and profiling. It basically gives cops freedom to detain any vehicle they see fit on the road and start an investigation.
If they want to pull you over all they have to do is follow you long enough and they can come up with something.

How do complex traffic laws encourage profiling? Are you saying black people can't drive?
Posted on 4/12/21 at 11:20 am to BiteMe2020
There are lots of ways to profile other than race. I would guess most cops profile traffic stops on a lot of different things. Race, model of car, age and up keep of the car, the number of passengers in the car etc.
In high-school I was never allowed to drive around more than 1 passenger.
Some of my friends hated me or stopped hanging with me because I couldn't chauffeur 4 or 5 people to parties, movies, sporting events etc. Parents wouldn't allow it.
A car packed with teens is asking to get pulled over.

I don’t disagree. Very minor infractions that 99% don’t know and hell even cops don’t know.

You have the right to say no. Most states don’t require police to tell you have the right to say no, limit the scope of the search and stop the search at anytime. I wish people knew their rights. If you say no, the cop can’t force you to consent or coerce you. If they request for a K9, they need reasonable articulable suspicion if they are going to extend the stop. If they run the dog during the scope of the stop (while the officer is completing the warning or ticket) then they need no proof of reasonable suspicion in most states. But the cop can’t stop completing the paperwork to run their dog themselves. The cop would be extending the scope of the traffic stop, therefor violating your 4th amendment.

Police don’t need probable cause. They need reasonable suspicion. Most states don’t have a law that prevents you from swerving in your lane, but they allow you to be stopped for a dui investigation. Again, if the citizen feels the stop was unjust or made up. I would highly encourage to file a civil complaint against the officer and/or department and speak with a civil attorney. Most civil attorneys are usually free when it comes to 1983 suits and get paid by winning suits.

I would disagree. K9 case law is one of the most prevalent cases presented and ruled on the SCOTUS or circuit courts. See Harris V Florida. The reliability standard. Most states require yearly certification and training records.

I wouldn’t disagree. How often do you monitor your speed? Do you know when you are driving 3 over the limit? Or when to signal 100 feet prior to turn or 300 feet in some states on the highway. How many people drive on I10 each day? Thousands and thousands, how many get pulled over less then a 1000 a day?

Not really. Even the minor infractions are common sense. Tint, license plate light, turn signals, color of lights, etc. Speeding, stop sign/light are easy to avoid.

Well every traffic stop is an investigation. Police are not allowed to profile on race, creed, religion, etc. just like hiring standards.
From meeting a lot of law enforcement. You typically have two different style of traffic stop enforcement.
1. The LEO who stop cars to give tickets. The arse hole of each agency.
2. The LEO who profiles on behavior and context of the area (interstate or area known for drug trafficking, area for drunk drivers). The LEO is looking for DUI’s and/or drugs.

Warrant issued on April 2, for failing to show up to court for the charge of:
"Gross misdemeanor carrying a pistol without a permit and misdemeanor fleeing police"
Daunte was previously carrying an unlicensed pistol and running from the police
Side note:
I am not gonna say anything about the kid and the black community. The white community does nothing for their own when they are victimized and don't stand together. Even innocent white mothers or children killed in cold blood...crickets. We should stand up for each other and be more like African Americans, who stand together for even the lowest among them. We should not be passive, peaceful, disarmed, and compliant in the face of injustice. Like the black community and this kid, we should be: fighters, resistant to illegitimate authority, and willing to stand up for each other. We should stop attacking and looking down on blacks for doing the right thing, having guts and standing up for themselves, exactly as we should be doing and are failing to do
