I'll give Massie credit if this passes, and hopefully it will. Until then, his track record doesn't leave much hope. Another failed bill just isn't as impressive to me as it is to his supporters.

Seems like Congress has already stated this - at least that is what I remember from the scotus case. But I could be wrong - anyone know for sure?
Maybe this would make it clearer, but the real issue will always be the language of the 14th. Congress (nor the President) obviously cannot override the Constitution.

There was no concept of illegal immigration in the US until 1875, so the author couldn't possibly have thought it applied to a concept that didn't exist at the time.

I also found an argument recently that the text says "all persons born" referring to the child, not to the parents, so the parents status is irrelevant. Don't think that argument jives with the ruling in Wong Kim Ark, but it's an interesting argument.

Yes, if it gets close to getting passed, he wont vote yes. As long as it has no chance to pass, he'll vote yes.
