Depends what state you’re in.

Louisiana Legislature passed a bill, and signed by the Governor, that actually allowed for pore space imminent domain for the planned CO2 storage “complex”. However, I’m not sure the LA DNR knows yet how to enact such in practice. Maybe they’ll do it similar to a hydrocarbon unit. In Louisiana, you must have at least 80% of the mineral owners within your proposed drilling unit either leased or participating as working interest owners. If you don’t, then you drilled a well in mineral trespass.

Minerals owners have zero to do with storage. Surface owner controls storage. If Surface owner is mineral owner then I guess it does come in play.

Plenty safe, just a massive waste of money.

Are they piping it in or building something on site to capture from the air?

That's interesting and makes sense.
The molecule that makes up .04% of our atmosphere is low to the ground, where the trees need it to thrive.
SO, how are "increased CO2 levels" raising the Earth's temperature?
By insulating the radiant heat collected by the Earth its self in the lowest levels of the atmosphere?
What is the R value of air density at sea level?
A twenty-five percent increase in CO2 levels brings the content to .05%.
None of the argument makes sense.
Plant more crops and tree and the non-existent problem is solved.

I’m well aware the pore space is a surface owner issue/right in Louisiana.

I’m just trying to guess how the LA DNR and legal process might be used in practice in relation to the current Carbon Sequestration Act and statutes in Louisiana. Are they going to allow eminent domain of an entire storage complex, or will there need to be a certain threshold under an agreement, like with mineral pooling.

Yeah, we were one of them. Got a nice chunk of cheese out of it, too. We could have made a lot more, but that particular partnership was shaky, so we wisely abandoned that business.

But it really doesn’t matter; it’s all regulated. You have to permit a class VI well and install monitoring wells. And you have to maintain them. The government regulating bodies will be looking over your shoulder. And anyway, as we saw with Macondo, the big boys take short cuts just like the private equity backed groups.
