Umm... You can't just say you were entrapped. You have to convince the judge. Sullivan has done thrown out convictions before for prosecutorial misconduct (overturned the Ted Stevens guilty verdict). Flynn isn't making the case for entrapment, though, probably because his lawyers don't think he can prove it and that Mueller will bring back in the conspiracy and foreign agent charges.

Yep. It was up to the Judge...He has the power. Not Flynn. Worse than cowardice...an abandonment of the Judge's Oath to serve a 'blindfolded' Lady Justice. Dude sells His soul...but he won't be alone.

The FBI did not meet the legal definition of entrapment.
Entrapment as understand it is making someone do something against their will. Within the time frame of FBI interview the FBI did not legally entrap Flynn. The FBI was HIGHLY unethical but they did not meet the legal definition of entrapment. So Flynn is not going to pursue it.
But from a common sense moral perspective the FBI certainly entrapped Flynn. But morality doesn't play in court.
