I think the best way to handle him is to sit him down and explain:
you're NOT going to War College
at this point, the caliber of your service is questionable enough that you won't be retired in grade
(and this doesn't happen particularly often, but I know of three cases)

What everybody said. He thought he was protected and got in over hes head. He's going to war college but essentially he's career is over. He'll be on CNN in a yr.

The only thing that can, and will, likely save his career at all is the negative publicity reducing and retiring him would bring.

If he has committed any act of misconduct, I must assume that he has been Relieved and issued a referred OER reflecting the misconduct. This adverse act would be sufficient to have his seat at the War College taken from him.
As such, if Vindman takes his seat at the War College later this year, we can assume that Vindman's supervisor took the easy road, did NOT write the OER to reflect Vindman's misconduct, and that Vindman was allowed to go along his merry way as if he'd done nothing wrong.
It is VERY common for supervisors to take that easy road because going through all of the administrative steps of issuing a Referred OER to the Officer takes a lot of that supervisor's time and effort. It is much easier just to let Vindman walk. Besides, do YOU want to be the guy that dinged a Democrat Hero on his OER? You think YOUR career would be safe during the next Dem POTUS administration if you do? Haw. That's why MOST supervisors would take the easy way and let Vindman walk --if you try to extract a pound of flesh from him, YOU'LL be marked as a target next time the Dems have the chance to bite YOUR arse.
So, for all practical purposes, if Vindman takes his student seat later this year, he will have gotten away with it, I think we can assume.
