Probably so. In addition to his appeal rights, apparently a federal judge in New Jersey is also blocking his deportation.

Rubio also said Khalil failed to disclose his employment with the British Embassy in Beirut, and the United Nations Relief and Works Agency (UNRWA) for Palestinian refugees on his Green Card application. That is immigration fraud.
