100% within this right. You think just because a LEO asks you a question, you are legally required to answer? Profanity is still protected speech. So from what you provided, what we have is: a person is recording government officials in the course of their public duties (first amendment protected activity), he is asked a question which he declines to answer, uses profanity and instead walks away (protected by first, fourth, and possibly fifth amendment), and he is tackled and handcuffed for it?
