Trump-appointed judge will handle request for 'special master' instead of Reinhart

Magistrate Judge Bruce Reinhart, who approved the initial warrant the FBI used to search Donald Trump's Florida home, will not handle the former president's request to appoint a "special master" in the case.
U.S. District Judge Aileen Cannon, a Trump appointee, will decide the issue. Cannon was confirmed by the Senate in 2020 in a 56-21 vote, according to the Epoch Times.

Trump, on Monday, filed a motion to appoint a "special master" to independently review the documents the FBI took from his home and to halt the federal government from continuing its own review.

I'm still not sure what the play is here. Can someone with the requisite legal acumen break this down for us. The DOJ has had all of these documents for two weeks now. Shouldn't we assume that the material they need for whatever they are "investigating" is already in hand? Does the Special Master tie that up somehow?

FRCP 53 governs Masters in fed court.
It sounds like the request was pretty vague as to why a Special Master is needed and as to what authority he should have. The District Judge has given the Trump team until Friday to file an amended pleading with more specificity.
USUALLY a special master is requested when docs are to be produced which are alleged to be privileged or otherwise not subject to discovery. The docs go to him first, and he reviews them for privilege and makes recommendations to the judge. Since the DoJ already HAS the docs, it seems a bit late at this point, unless there is a different reason for the request.
If anyone has seen a copy of Monday’s original Motion, a link would be appreciated.
EDIT:
Found the Pleading
Trump acknowledges that a filter team is already in place within the DoJ and in possession of the docs, but argues that it is inadequate, because the DoJ has “long treated (him) unfairly.”

It’s often used to screen documents that may be protected by attorney-client privilege. The FBI may also use “taint teams” for the same thing on their end.

Given their history with Trump, it would be silly to trust the FBI.

I'm no lawyer, but if FBI pulled whatever document they wanted and didn't report it, and some 3rd party looks at all the files and says "there's nothing here", wouldn't that look bad for the FBI?

A McConnell appointee.

If they had it they would have came out with it by now . My thinking is get another set of eyes in it so they can’t frame him and put something in there or just say it’s in there without the proof . We are not dealing with honest people here .

It's called 'Play the same chickenshit game the Dems play!'
You don't have to have a reason, just do what you want, isn't that how all of the jackass Dems play?

this isnt true btw, at least not yet. trumps lawyers, who cant practice in Florida because they filed their paperwork wrong, are judge shopping, and the new judge is less than impressed so far, she denied the initial request because it doesnt make any sense.
this is the judge essentially asking "why are you here?" "what exactly do you want?" "what was wrong with the other judge" and "what makes you think I have jurisdiction?"
its among the most embarrassing things youll ever see in an order, the judge has no idea what trumps lawyers are talking about.

This case is in federal court. All they have to do is get admitted to that federal court. Has nothing to do with Florida. How is going to another county going to do anything?

I think I'll just call the FBI "the taint team" from now on.

quote:Halligan is lead counsel, and she is Florida-licensed and admitted in her local federal court. Her out-of-state co-counsel may not yet be admitted pro hac vice.
trumps lawyers … cant practice in Florida
quote:Counties do not mean anything, but they DID file this in the wrong place. The Southern District of Florida has five Divisions. Mar-a-Lago is located in the West Palm Beach Division, and that is the Division where the DoJ got their warrant. Trump filed in the Fort Pierce Division, and there is no basis for filing there … other than hoping to get a better ruling from a District Judge that he appointed.
judge shopping in a different county
quote:It may or may not make sense, but she failed to grant ex parte relief because everyone in the entire country knows that the other side is represented by counsel. Hell, Team Trump named that counsel in its Certificate of Service.
she denied the initial request because it doesnt make any sense.
quote:Damn, that Order is harsh.

Is he supposed to go to the same magistrate and ask for oversight on an investigation he signed off on? You know this stuff. Come on.

Really? Yikes. Some soft attorneys in south Texas, I guess.
