Saw a post on Louisiana Deer Hunters facebook page about the dove season citations and tagging migratory birds. Someone recommended looking up the story of Ryan T Warden on Spotify, so I did. It's pretty fascinating if anyone wants to listen.

Tl;dr version: two undercover federal wardens essentially book hunts with outfitter over 3 year period, and entrap him into committing wildlife related misdemeanors, that because he was an outfitter, automatically became felonies.

They didn't have enough evidence in year one? I remember some time ago of the feds setting up a group of outfitters, I think, who were taking customers snow goose hunting and killing HUNDREDS of birds over the limit, over baited fields, and they did something similar, hunted with them several times and videotaped it. The penalties the first time would have been a serious deterrent but when it happened several times the public outcry negated most of the deterrent.....folks actually felt bad for the outfitters. The rumor then was the feds were enjoying themselves.....killing way over a limit over baited fields. Lousy police work if true.

Reminds me of when undercover cops bust "rub & tug" massage parlors. Sometimes it takes years and multiple trips in by the agents to gather enough evidence.

I believe they would only become felonies if there was something regarding state lines or interstate transportation to make them felonies.

They used the Lacey Act, so that makes sense. Dude essentially didn't have hunters and guides separate and tag birds. Something about how if 5 people went hunting, and the limit was 6 birds per hunter, he would just make sure 30 birds was the stopping point for the group instead of keeping track of who killed what, and making sure each person only killed 6 or less.

He shot one over the limit sitting on a tailgate, so they got him for that and said since his feet weren't on the ground, it was hunting from a vehicle. Then the Lacey Act was used since it involved migratory game birds (dove). Also gifted meat to the agents, and was ticketed for that.

They ruined this dudes life, caused a divorce, forced him to sell his outfitting business, and more all over shooting a single dove over the limit sitting on a tailgate essentially.

I'm listening now. Guy sounds pretty down to earth, but I have to call some BS also. Feds paid for 30 hunts, I've met plenty of game wardens and plenty of them have been dicks, but I have a hard time believing that they put that much effort into a guide service that didn't have A LOT of questionable acts going on.

If they spent 30 hunts and this is all they found on them, that's pretty remarkable if we are being honest. The judge should have laid into the agents about all the time, money, and effort they put into these lame arse charges.

So not to ruin the story, but that question comes up at the end, as it doesn't make sense to the podcast hosts why they even started the investigation to begin with.

He was told it was due to his social media pictures of piles of birds, ducks, geese, etc. which weren't separated into individual limits. So they knew there was no way he or his guides knew who killed what on an individual basis.

Sure, and that takes no more than 2 good hunts to figure out. Why 30?

ETA: At the end of the day the Feds really had nothing on them and that's why they used the laws they used, that was all they had left.

I'm not quite sure why his story about the Feds each shooting 2 birds to put them over the limit would not be a Federal offense. Hell, he said he suspected they were Feds. Why not report that to a game warden right there?

When they took down Game Trails, they watched them for several years prior to filing charges. It's crazy how much dirt they can put together on outfitters.

I have a friend who is a Game Warden. First piece of advice he gave me was “Take any ticket you get to court” they have a terrible conviction rate. Me and my son will be hunting teal this weekend. We will kill 12 birds. I’d like to see the. Prove that my son shot 7 and I shot 5 in court. I know when I hunt I claim every bird that falls out of the sky. Even if I don’t get up to shoot.

You are correct about fighting charges in court. Don't even have to hire a lawyer. The judge likes it when you represent yourself. I beat an after hours charge back in the 80's against Assistant United States Attorney Joseph Jarzabek. Asked the Green Jeans if he actually saw us shooting. He answered, " I saw silhouettes. " The judge slammed his gavel and told Mr. Green that he couldn't put silhouettes in jail and I was free to go! It was a beautiful thing.

Well, both are just cops/wardens wanting to get enough evidence.
How much is enough evidence?

Maybe after I killed 200 geese or experienced multiple rub&tugs to realize a crime had been committed by those other guys and gals.

This all the way. Take about 30 hunts with a guy over 3 years on the taxpayers dime and that is the only thing you can get him on. Total BS. They should have given him a couple tickets after the 2nd hunt they went on and spent their time finding someone who was actually doing something wrong. Ruining a guys life over tagging, one dove over the limit on accident and shooting one dove from the tailgate of a truck is a travesty.
