Once school starts back, which is indeed around mid August, is the time to go. By mid September you might have the beach to yourself.

There is a good 2-3 weeks after spring break that is pretty fantastic as well. Temperatures are good and its a ghost town.

For the sake of this thread's discussion, last time I did that we rented chairs through the hotel/beach service. Someone went and set up their family of 6 chairs right in front of us, legit like 5-6 yards in front of us. Meanwhile, if they went like 30 yards in either direction, they would have had areas completely to themselves as the beach wasn't crowded.

Those type of tent people are the damn worst. There are plenty uppity service people that are assholes too, but the tent people or people with their own shite that set up directly in front of the chair service, just to be a dick are awful.

Makes me thankful that we go to a private beach that isn’t assholes and elbows.

Its funny how these people are arguing saying the tents are trashy or the others saying the chairs are trashy. How about both of yous is trashy. If you at a beach where a single family can't capture 20-50 yards of the beach to their own, then you are in a trashy area. So guess what you chair and tent folks, you all trashy.

Don't have this problem at Haulover beach Ft Lauderdale, most folks want to be set up back off the shore line for a better view of the nudes

Why people continue to go to public beaches and expect a private experience is always a head scratcher.

This is a large reason we don't go.

Private beach house is too much for us. My wife and I have great memories of the beach as teenagers and we don't want to frick it up.

This is a good point....surf fishing in parts of Florida can also be good that time of year...

I am very much into the chair service experience as I get older. OT Ballership has it's advantages.

pretty much the only things that give any of these condo owners leverage are 1) they probably know all the cops that might be called to enforce the seat / "trespassing" stuff and 2) no one wants to deal with the legal hassle it would take to win in the end, even if their cause is righteous.

This is how they "win". I wouldn't fight them either and would make certain I wasn't be an a-hole but I have had them tell me, while I was fishing, that I was trespassing and that's a whole other side of the coin because to allow them to crazy eye you over fishing is to let down the next fisherman who comes along....confront me while I am fishing and you better have the FWC on the way because you going to have to physically remove me and I ain't nothing if not heavy LOL....I am about as far from being Billy Badass as they come BUT I am white trash Scots Irish from the southern foothills of Appalachia so I can take a helluva beating and ain't afraid of violence LOL...taking or occasionally handing out an arse whuppin' was a normal Tuesday until I matured enough to realize it wasn't what normal folks do. Some entitled a-hole who thinks they own the gulf or the ocean can kiss my redneck arse...I may not whup his arse but that fricker is going to be worn the frick out before I ain't on his beach.....its going to be waaaaayyyyy more work than he could have possibly imagined. And again, only to potentially keep it from happening to the next fisherman....my preference would be to be left the hell alone but if you insist I am going to leave public property you got it to do....

I was team chair til my last beach trip and decided to just try the tent thing bc we were so close to the beach it wasn’t bad to carry the crap out there, im now FIRMLY team tent. I can setup my 10x10 tent, about 4 feet off the ground and setup my chair under and not fry in the sun. But i never setup on top of ppl and i dont care if im at the water line or back behind the chairs. Im just glad im not at work.

The legal concept of customary use begs to differ....and has lost everytime.

Only if it meets the "customary" criteria of the public use being:

-ancient (at least 50 years of consistent use)
-reasonable (activities (walking, fishing, sunbathing, etc) that do not unduly interfere with the owner’s rights)
-without interruption (ie: continuous use over time)
-free from dispute (no significant historical challenges to public access)

All that said, in a lot of cases someone would likely need to go to the extent of filing a lawsuit and getting a ruling after being harmed/harassed by a chair company in order to get a specific area considered as customary public use.

From my pokings around on the interwebz, there doesn't seem to be a site nor map which shows which areas fall under customary public use and which do not so it boils down to how much effort someone wants to put into fighting "Big Chair".

It's a trade off sliding scale of what do you wanna prioritize. a beach trip I'll take peace and space for my son over nice water all day..would I rather have better water..for sure... but not if I gotta deal with tent cities full of jackassess blaring their bluetooth speakers

For us it’s a good day trip. And to add the beach itself is pretty nice.
Plus, you can also cowboy up and hit Ship Island, tho I have not been in several years. But that always seems really nice despite the ferry and hike.
