Possible violation of the federal Religious Land Use and Institutionalized Persons Act of 2000.

They might be able to argue arbitrary and capricious decision, but that seems harder to prove unless they can show that no church in the municipality has ever been denied a land use approval even with similar development concerns, and that might not be enough.

I think it should be a hard path to overturn a local decision like this, and sounds like they put valid concerns in the record of the decision, not just we don't like yall. That said, would a Christian church be denied.

I guarantee no one wants this to go to lawsuit, discovery would not be fun for a lot of people.

It is not over yet. The matter will still go before the Hoover City Council. The City Council can still approve the school. This site is on the edge of Hoover, an area recently annexed into Hoover. Many of those speaking live in unicorporated Shelby County.

I don’t think the constitution was written with the thought of so many muslims being imported into the country, nor is islam compatible with the constitution.

It was also not written to apply the 1st amendment to the states. An unintended consequence of incorporating onto the states a specifically written and ratified limitation on Congress has made stopping muslim schools like this and muslim neighborhoods like in Texas a tricky legal situation. It has also led to takeovers like in Dearborn and Little Somalia Minnesota when certain Presidents started to import a ton of 3rd world muslims with religious views and cultures that aren’t compatible with the constitution or the American way of life.

If religious schools are ok, they should be protected, absent a reason based on location/zoning law, but the council denied the bid to rezone the area for a school. Quite a few businesses are located in that area. The crowd/objectors weren't necessary (not arguing they had no business being there). Case closed.

Edited: Not the council, the zoning commission. I assume the council will uphold it, but not absolutely sure.

The council elections in Homewood were scary as hell. They had a secret PAC pushing their candidates.

Thankfully they elected a conservative in the runoff who will hopefully make sure the moderate mayor stays moderate.
