Is that in the law? Doesn't sound very legal.

As a general rule, initial aggressors aren't allowed to claim self defense, even if they start getting the "worse" of the conflict. You don't move from aggressor to defender just because you're losing.

Now, again, without seeing the beginning of the fight, we have no way of knowing which way that would cut here. Green shirt might have been defending himself the whole way.

In many conservative southern jurisdictions, this will likely be considered self defense, in NYC, who knows?

Don't live where people who disagree with you hate you with every fiber of their being. I loved Denver, but I left when it became apparent if anything happened, they'd cheerily throw me in jail for the rest of my life.

Even in the south, you can be prosecuted by those who have political agendas. In the situation in the video, if that was a white guy and he shot the attacker in Jxn, MS there's a decent chance he'd be prosecuted. At the least legal fees would be in the 10s, if not 100s, of thousands of dollars. In neighboring Rankin County, the shooter would get an award and be hailed as a community hero.

I knew that, just didn't realize it could be called "menacing". I don't think any of us, without further details, can know if he started this. Would it be menacing if there were multiple combatants striking the individual and he displayed the gun to get them to quit, assuming he didn't start it?

"Menacing" isn't really a concept that gets much, if any, play in Louisiana law.

Actually, just googled it. New York's "menacing" is functionally identical to Louisiana's concept of "assault".

Life wasn't in danger? Dude snuck him from the back. Hit your head in the ground and you're dead in many cases. He acted in self defense. Only fools say otherwise.

He innocent on self defense?

The man in green started the physical fight. He then pulled his gun before man in black punches him in head

He has ZERO self defense claim

Non gun owning American checking in. Not only 100% justified, but the man stopped further violence and broke up the fight immediately

You can't see who started what. I slowly went through it. The gunman is already engaged with another when the crowd parts for the video.

We don't know if he was justified or not in pulling his gun out.

It's inconclusive based on the OP video as to whether it's self defense.

According to “black twitter”, two guys in green threw punches at other guys. Fight starts.

Guy in green goes to ground and grabs his gun. Guy in black not in original fight hits the gunman. Gunman starts shooting

Apparently there weren’t any major injures either

It’s black on black so don’t think they would have an agenda here

He had the gun out at the begining of that when he was already in a scuffle. If you are defending someone with a gun you dont engage in wrestling, you point and shoot. Those facts lead me to believe that he pulled the gun mid scuffle and, seeing as he wasn't the only person being attacked, was involved in some level of initial aggression.

Therefore, lacking any more evidence for now, my ruling is not self defense.

If you have access to the full video why not just post it or at least confirm that you've seen more?

If you did see a full video, you're just confusing by people by not saying that, because what you're saying is factually incorrect if we base it on the only video we are all debating.
