Cheating has zero ramifications on anything in divorce settlements. Can’t use it in court.

A friend of a friend is a PI here in Scottsdale and told us years ago "if you saw what I have seen you would never get married". Other buddy didn't listen and went thru a painful (and expensive) divorce last year.

Who said anything about court? The insinuation was he caught so many cheating on their spouses, which directly led to the end of their marriages when he shared that information with the party who hired him. Nothing was said about using that info in court.

Laws must be different for individual states. I had photos and video of my ex cheating. She actually brought a witness to court that testified she was aware of the affair.

I got the house, kids, and kept my 401K

Adultery does not determine who gets what, it just solidifies clear grounds for immediate divorce.

What you get depends on the property settlement, unless someone signed a prenuptial, is always split 50/50.

And you only get kids if the other parent does not want custody. What state do u live in and who the frick did you marry?

That's not entirely true.

If shared assets (bank account, credit card(S)) were used to pay for gifts or meetings with frick boy(s), then those should be inserted and earmarked into the filing for return.

I did this in KY, and it's the same as LA.

Get definitive proof. Then you won’t have to pay alimony.

I know. But it was the first pic I could find and I like the name Tommy Grand better.

I didn’t know Clark Gable died.

I watch reruns of Cheaters almost every weekend on VH1

Wait until she goes to work and empty the house out. She will come home to a house with no furniture or beds. The look on her face would be priceless.

Worked for me. I also had a prenuptial agreement that there was no community property during the marriage, which was great for me. I paid for everything, so she had to start all over. That feeling I felt when she realized she fricked herself at the mediation hearing was awesome. She is the one that insisted on the prenuptual agreement. I could see the life drain out of her as she was told she wouldn't get anything. No loss for me, she was fat and grotesquely obese

This post summed it up well. I would reiterate that if you have evidence of cheating you can absolutely bring that as grounds for not paying alimony to her. Other than that it’s not much of a benefit to you. You may also be able to use it to show “poor decision making” on her part as grounds for you getting domicilary custody. Which is absolutely HUGE if kids are involved.

Moved out because the house was hers before we married. I built a house when I left the fat arse.

Wrong. In Louisiana, statutory law makes at least two important distinctions between divorcing a cheater and other divorces. First, a court may only award "final periodic support [alimony] to a party ... who is free from fault"--cheating is a "fault"--under Civil Code article 111 ( Legislature's website). Second, adultery is one of the grounds on which you don't have to wait a 'cooling off' period of time before getting a divorce. See Civil Code article 103 ( Legislature's website).

It also may affect things like child custody. And in some states a cheater may get less of the marital property under various concepts of "equitable distribution" and similar.
