The plane was not being tracked by radar, have not seen it stated, but could have been an hour since last radio contact, with a massive system failure the transponder would be dead, if the plane sunk the emergency locator transmitter signal does not work under water.

The transponder has two independent battery backups. It is waterproof and fire proof.

talking about an older air france flight in 2009 that was 100% pilot error.

I know. But I'm only aware of a transcript posted. I didn't know a video or audio was available.

Tracked by radar at 35-38k ft tells you what? it gives you a general search area that could cover an incredible amount of square miles....it wouldn't just drop straight down

According to a 777 pilot on another forum, it could glide, powerless, for 100-120 miles for 25-30 minutes from that altitude.

Of course, if that happened... why no distress call?

It would give them a smaller search area than their current predicted 500,000 square mile search area. In other words, I would have, maybe, a 1-square-foot area to search for the pinhead.

And, the emergency ping transponder?

If we take 120 miles in all four directions, that gives us a roughly 57,600 square mile search area (240x240 miles). Roughly an area the size of Iowa. Easily searchable within three days.

This plane had it's wing damaged recently in a collision with another plane on the ground while taxiing at an airport.

Wonder if the repairs failed them?
