Well I had a full set of drawings and I looked through them and then I looked at my 2nd graders crayon art taped to the fridge and I realized her drawing was better.

Then I read the spec book and later realized when I was reading to her that Horton Hears a Who! was much more informative as well.

And I passed on the project.

Wait... wait... Tommy Spinosa fricked some people out of money?!

Just wondering, how has nobody beaten the ever living shite out of the guy yet? It seems to me that ANYTHING associated with him is a con and has been for a really long time.

I have zero sympathy for anybody who gets ganked by him at this point. If you didn't know what you were getting into with Spinosa, you were kinda asking for it.

IS that picture that WBRZ posted (of the road) the servitude in question? Looks like they could take 5' on each side and establish it as a road to restore the servitude to the right size.

I also read something a while back (probably in that original thread) that if they granted the landowners another servitude of the same size and access, that would remediate the issue. Was there any merit to that or, something a TD poster made up?

I think the whole "houses must be torn down' is click bait by WBRZ....

It amazes me how our dumbass metro council agreed on these plans, knowing that a servitude needed to be established at that width. A simple request to move the lots back 5' would have kept this entire problem from happening. Those in office should be held personally liable for the punitive damages the landowners will receive because of this.

The chilled water was the very first thing built on that property and that was a very smart move on his part to set that up as a separate company.
smart move? you mean a completely crooked move when he starting price gouging.

Didn't the new owners of PR basically tell him they'd build another one and leave him with a worthless Plant when he tried jacking up the rate for PR?

Sucks for the people living there. But I'm sure they can sue Spinosa as well and get some money out of him

Spinosa diminished the servitude from 30' to 20' in a spot.

My question is how the builder got a permit, passed multiple inspections, and the owners received a Certificate of Occupancy if the house was being built in a servitude the entire time.

Seems like the City may have some liability if I am understanding this correctly.

Don't worry...they are also being sued. Cannot rezone property from A1 to TND without owning all of it.

Developer could have given them their servitude. Metro Council could have actually done their homework before approving something. Original residents probably were assholes. Now they are justified in their anger...Can't even get a fire truck on their property in an emergency.

The city kept changing the rules to help Spinosa. He also uses the shadiest engineers. They resubmit items to planning commission with minor changes but sneak in major changes.

The 'landowners' gain nothing by making him tear down the houses

Uhhh, yea they do.

They gain the servitude back which gives them direct access to their property.

Seems like a pretty big deal to me to get that back.

Yeah seems like paying a few hundred thousandis simpler

But now that lawyers are balls deep in this they will want millions

To be fair, knowing how much the houses are selling for, asking for somewhere in the millions in monetary damages is not far off the mark.

And while a lot of contractors at Perkins Rowe got jammed - the majority of those were contractors that were on the back end - who worked out there towards the end of construction. A lot of the very first contractors got their money and I know several that were popping him for big change orders and made a bunch before the money ran out.

So, the fricker runs a construction pyramid scheme....

The floor drains in the kitchen at Kona Grill were installed too high, so the floors didn't drain as intended.

I would rather pocket a few hundred grand and not have to make people who bought those houses turn their lives upside down through no fault of their own. Seems worth it just to add a couple hundred extra feet to get to their driveway.
