The guy showed up to a rally with a loaded pistol . He even kicked an ICE vehicle and spit on it. He was acting erratic and dangerous.

Hate to say it but it but when the victim and the perpetrator know each other and have had a confrontation, a unscrupulous procecutor can argue first degree murder. The grounds are premeditation.
Also in the video it is clear that the victim was disarmed before being shot. That negates imminent threat.
The ICE agents could be charged with murder. Luckily this is a federal case, and we have a rational DOJ.
Trump should grant them a provisional pardon...like President Nixon got.
