This story is exactly why I try to practice 3 shot volleys when at the range.
Two in the red, one in the head.
Holster and call the coroner.

You can argue the semantics of 'may be used against you', but you start talking without a lawyer present and say something wrong and you'll wonder how you could have possibly been so stupid as to say that later when it comes back to haunt you.
Don't say shite without a lawyer beyond what Bapple said. Who gives a shite what that cop thinks? He likely understands why you're doing that better than you do and would do the same in your place.

Back to the original post... the OP provided a second hand story, and some of ya'll are picking it apart like it's an official report, trying to make it seem like there's some conspiracy or something. The guy fired 15 or so shots and hit 7 times... do you really think 6 of his hits were dead center of mass and he cleanly missed the other 8 times, get real... they were probably mostly in the general vicinity of the center of mass, and the OP exaggerated a bit. Regardless, handguns perform very poorly in comparison to rifles. As Bapple said... the Perry Stephens/George Temple incident is a perfect example...

I think some of us have watched way too much drama cop shows. They are going there to investigate a incident, no crime has been charged or arrest made at this point. shite, we have people in the thread advising to send your two witnesses to the mall for Gods sake

Good Grief! The 40 cal round is now being questioned? OK!! C'mon Man. It is just luck of the draw sometimes and the dude is unconscious on life support...in other words- He's fricked.
I saw a man get shot through the chest with a 357 Magnum at the Office Lounge in Ferriday, LA. He was in the bar drinking again in two weeks. 357 went clean through a lung. No problems.
On the "Talking to the Cops"....this is pure Bull Crap Stupid. And Alx Tiger is an atty and knows it. Bapple and Faxis are absolutely correct. The one thing I was taught in my CC class in TX was to say NOTHING. Even your 911 call is evidence.
A 911 call should do only this:
1) State that you have been the victim of a crime.
2) State the location as 123 ABC St.
3) Send Paramedics and Ambulance.
4) Let Dispatch Confirm.
5) Hang Up.
Everything else is a record that will be used by the prosecution.
Get a Texas Law Shield account or something of that nature, and the literature gives you a script on the credit card/phone number/wallet thingy.

Are you under the impression that they won't use what you just told them about the incident against you as evidence in order to arrest you?
Lets say they don't arrest you but you said something stupid that makes for great evidence against you in a lawsuit.
