Orrrr.... the courts may decide for us that, in fact, we just bout YETI coolers at a very discounted price.

RTIC filed a suit in Houston against YETI -- that case has been moved to the Austin district and will be tried with the original Yeti vs. RTIC case.

Doesn't look good for RTIC.

Because so far, RTIC has failed several legal manuevers to try to get this thing thrown-out. It isn't happening. It'll go to trial.

My neighbor has an original RTIC from when they first came out -- side by side with a YETI, they are identical with the exception of the placement of the latches and the name/logo.

I don't see how RTIC wins. But, I'm not an attorney, so obviously just my opinion.

RTIC Coolers asserted that it merely processes the credit card charges on behalf of RTIC Drinkware. Regardless, RTIC Drinkware is now a party to both lawsuits.

RTIC also argued in its Response that RTIC Coolers was an improper defendant to the First-Filed Lawsuit and, therefore, the Austin case should not be considered first-filed. The argument that RTIC Coolers was an improper defendant was the subject of a Motion to Dismiss filed by RTIC Coolers in the First-Filed Lawsuit. By Order entered July 19, 2016, the Honorable Robert Pitman rejected RTIC Coolers' argument and denied its Motion to Dismiss. See Order, Exh. 1 to Yeti's Notice of Order [Doc. # 26].

In the First-Filed Lawsuit, Yeti alleged that consumers could purchase infringing drinkware at the website "RTICCoolers.com." RTIC Coolers argued in its Motion to Dismiss that the website "RTICCoolers.com" is operated by RTIC Web Services, LLC and by Corporate Support & Fulfillment, not by RTIC Coolers. The district court in Austin noted, however, that Yeti alleged that "RTICCoolers.com" expressly stated as recently as early 2016 that it was "operated by RTIC Coolers, LLC." RTIC Coolers argued before the Austin court that this was a mistake. --------

The lawsuit Yeti filed in Austin is the first-filed, having been filed against RTIC Coolers, a party adequately related to RTIC Drinkware, two months before this declaratory judgment action. The parties and issues in the two cases now substantially overlap. There are no compelling circumstances that weigh against following the "first-filed rule" in this case. Indeed, this appears to be a classic case for application of the "first-filed rule" to transfer a declaratory judgment action to the court in which the first-filed affirmative trade dress infringement lawsuit is pending. As a result, the Court will grant the Motion to Transfer and will transfer this case to the Western District of Texas, Austin Division, to be considered in connection with the First-Filed Lawsuit currently pending there.

I got a confirmation email immediately after ordering and a shipping notification literally a minute later.

Same here. I ordered at 6:18am this morning and receive UPS shipping confirmation/tracking at 6:20am.

I was hoping to have a little more time to butter up my wife before the damn thing arrives.

I think the OB is flooding them with orders. Told me mine will be shipped in 1-2 days. Said they are working as hard as possible to get ALL these orders out lol.

Of course I don't get the 24 HR express delivery.

I figured the same, I ordered today around noon and it said expected to ship tomorrow but I just got a UPS tracking number saying it shipped today, no expected delivery date on it yet though. Would love to have it before the weekend.
