"Our conclusion about habeas jurisdiction requires us to answer a second question: Did the Immigration and Nationality Act (INA) strip the New Jersey District Court of subject matter jurisdiction? It did," the court stated. "Because the INA channels '[j]udicial review of all questions of law . . . arising from any action taken or proceeding brought to remove an alien from the United States' into a single petition for review filed with a federal court of appeals, we hold that the District Court lacked jurisdiction over Khalil’s removal proceedings."
Khalil, an Algerian citizen born in Syria who became a lawful permanent resident in 2024, was arrested in March 2025. Officials charged him under INA provisions for activities with "potentially serious adverse foreign policy consequences" and for obtaining his status by fraud, citing undisclosed affiliations.
Khalil argued the actions retaliated against his speech criticizing Israel's Gaza operations and Columbia's role. He was released in June 2025. The ruling channels Khalil's claims to a petition for review after a final removal order. Without the district court's orders, officials may resume detention and removal, though Khalil can appeal through immigration channels and then to the Fifth Circuit.
The decision reinforces INA limits on district courts in removal cases, ensuring claims get reviewed in appeals courts post-final order.

I'm sure the District Judge tyrant will just issue another injunction anyway. Trump admin should simply point to this ruling and tell him to shove it.
