This is exactly what he was doing. I think initially he didn't want her to create a spectacle in his court room, but eventually said f it & let her dig herself a deeper hole.

I seriously doubt that the " reimbursement " using cash that nobody can account for does not cross the line above but the question is, I think, is just that alone enough to remove a prosecutor from a case?
I do not know if more is required . She is not a truthful person and neither is wade but the judge would have to write that opinion and I doubt he wants to do that:

The only things that matter are that she failed to report the personal relationship when she hired him to be the special prosecutor and that damn disclosure form.
If you’re a judge in Louisiana, you basically are required to report if a lawyer picks up the check for you at lunch. Even if it’s your college roommate or something. She hired the guy and doesn’t think she has to report him taking her to dinner, or document that she paid him $2500 in cash?
Plus - I’ve known of law firms where if you’re dating a coworker, their nepotism (CYA policy) has been that you’re under a duty to disclose the relationship, particularly if it’s a supervisor/subordinate situation. I cannot Imagine that a Gvt job wouldn’t have that crap.
I think those issues get both of them kicked off case.
It’s not the fact that she was fricking him that matters. It’s the fact that she had duties of disclosure and failed to disclose. That’s characterized as a misrepresentation under the law.
PLUS - I love how the Wade thinks that because he thought his marriage was over he was divorced.
