Direct violation of the First Amendment. Hate crimes are by definition punishment for thoughts. The actus reus and mens rea are already elements of the underlying crime. So literally the only thing this "hate crime" punishes is belief/thought.
The physical expression of that belief is punishable here, was punished here and should've been punished here, as it wasn't his property and violated safety laws.
But it is wholly irrelevant (except perhaps to show the intent element of the underlying crime) that it was a gay flag.
This is truly scary as shite.

He must of had some really bad lawyers, who were working for the prosecutors.

He burned someone else’s property. That is illegal. If someone set your American flag hanging outside your home on fire, they could be prosecuted.

This was a horrible sentence and hate crimes shouldn’t be legal to begin with, but he likely pissed off the jury with his comments to the media after he was out on bail.
