You want constitutional judges not hacktivists.

When they follow the law we all win

Which is why we have to keep court

What is it when democrats draw it?

I was hoping one of the board lawyers could respond to my question:

quote:

quote:

Complicating the matter was the fact that the state’s Supreme Court flipped after the 2022 midterms, with the subsequent GOP majority ruling that they did not have oversight in the matter. The 4-3 Democrat-leaning court turned into a 5-2 Republican-leaning court.

It was the 4-3 Democrat state supreme court that ruled against the GOP map. The GOP legislature took the case all the way up to USSCOTUS. USSCOTUS basically ruled in favor of the 4-3 Democrat state supreme court.

Now that the NC state supreme court is 5-2 Republican leaning can the NC state legislature move forward with a tweaked GOP leaning map then the Dems will challenge and eventually the NC state supreme court will rule in the legislature's favor and it will be backed by the USSCOTUS?

I have to read the decision but if the reasoning in OP is roughly correct, a new decision of the NCSC would be binding.

That would be some damn irony.

funny how the plain language of the Constitution is "subject to interpretation"

it's useless to rely upon the SCOTUS to protect the Constitution

Yes

Compare how Thomas responded, to how Kav responded. Thomas refused to bend, and has never bent, Kav appears to be terrified of upsetting anyone.

after the assassination attempt on Kav/family they now have a proven tactic on him going forward and knowing it works will widen the application of it

Just let the states do what the states do.

This is humorous because the NC legis was trying to say the state courts have no jurisdiction over maps

Independent state legislature theory was a pretty radical power grab more in line with Articles of Confederation principles.

I’m curious to read Thomas’s dissent for the historical basis for his opinion.

Why did they essentially take more power away from state legislatures?

gerrymandering districts.
look at the majority black districts in almost every state and tell me those are not gerrymandered to give democrats districts. They all look like Rorschach tests. So in the judicial mind, including trump appointed justices, you can only gerrymander if it's going to create a white majority district, if it's going to be a black majority district is never gerrymandering

Trump’s choices aren’t necessarily home runs

None of the SCOTUS appointments were Trump choices. Trump made a deal for support in his Presidential bid. Part of the deal was that he would rubber stamp the choices of The Federalist Society.

News media is awful reporting on law. Stories are almost always incomplete or inaccurate. Usually both.

The decision in this case is 100% correct. The theory that state legislatures aren't subject to their own courts was a (deliberate?) misreading of the US Constitution. Originalists know the founders didn't mean that when they wrote it.

The NC Court has already overturned that ruling, making this case largely moot.

And the dissents had nothing to do with a different interpretation of the constitution. They just said "the state court already overturned this, so go away. We don't need to decide on the merits."

The media sucks. Don't be so quick to hate on our guys (and gal)
